Texas court allows surrogate baby with heart defect to relocate to California for treatment
The Texas Supreme Court ruled Thursday that a medically fragile month-old infant born to a surrogate can be moved to Los Angeles for specialized cardiac care.
The Texas Supreme Court decided the child, born after surrogate McKenna West rejected the biological parents' request for abortion, can be relocated to Los Angeles where the couple lives. The court cited the child's rare severe heart defect, writing that "sustaining the life of the medically fragile child is the paramount concern in this time-sensitive matter."
West had attempted to block the biological parents from removing the child from Texas. The ruling follows a California court's earlier recognition of the biological parents' custody rights in the ongoing legal dispute.
